Why the EdChoice voucher scheme is unconstitutional—Part 1

In 1851, the people of Ohio gave the legislature the profound and majestic duty to secure, by taxation, a thorough and efficient system of common schools. That duty has never been repealed or altered.

Beginning in fiscal year 2022, the legislature began funding EdChoice vouchers out of the same State Budget line-item that allocates funds to the public common school system. The illegality of the transfer of funds set aside for public common schooling is exacerbated by the fact that the Ohio Supreme Court ruled the funding of the public common school system unconstitutional more than a quarter century ago.
